论我国群体性纠纷诉讼解决的配套机制

On China's Necessary Systems for Group Litigation Disputes

群体性纠纷的特征决定了其通过诉讼解决时理应有不同于一般诉讼的特点。利用诉讼方式解决群体性纠纷时,除了坚持不同于一般诉讼的代表人诉讼之外,还应该在配套机制方面进行完善。结合群体性纠纷的特征,在对群体性纠纷进行诉讼解决时应注重律师、法院调解和陪审制的利用。

Because of their characteristics,when to be solved by civil litigation,group disputes need the special civil litigation different from the general civil litigation.So,except that the representative lawsuit is needed,the necessary systems are needed too.In view of the fact that group disputes are special,it is necessary to value the functions of lawyers,court mediation and jury system when they are solved by civil litigation.
