摘要
中国古代商人的法律地位从总体上来说是卑下的,这与当今商人的境况大不相同,许多学者认为贱商法律思想产生的原因是儒家义利观的影响。但细加分析就不难发现,这实际上是学者的一种误读。
The legal status of ancient Chinese businessmen was lowered in general,contrast to the current situation that businessmen are an integral part of the society.Many scholars hold that legal contempt for businessmen is caused by the Confucius view of righteousness and interest.This article starts from this misunderstanding and analyses the value orientation of utilitarianism that affects the legal contempt for businessmen.
