欧美反邪教立法模式比较及其借鉴研究

A Comparative Study of Anti-cult Legislation in Occidental Countries

欧美各国在运用法律打击邪教的过程中,形成了不同的立法模式。美国极端重视宗教自由,承认邪教和邪教组织的存在,但注重综合运用现有立法中的相关条款打击危害社会的邪教活动。以法国、德国为代表的欧洲大陆国家则在保障宗教自由的基础上,制定了专门的反邪教立法,设立专门机构应对邪教的社会危害。欧美等国应对邪教的不同立法模式为我国反邪教立法的完善提供了有益的借鉴。

In the process of guarding against and punishing crimes committed by evil cult gangs,the Western countries have established different legislative models.U.S.puts undue stress on religious toleration and permits existence of cults and cult organizations.But the U.S.government focuses on the application of relevant clauses of the common criminal law to punish criminal activities of cult organizations.The Europe countries such as France and German also respect for religious freedom,but create special anti-cult legislations and government organs to deal with the cult problems.The different legislative models of the anti-cult laws in occidental countries provide us with a useful mirror to improve the anti-cult Laws of China.
