论电子证据的证明力

On the Probative Force of Electronic Evidence

我国民事、刑事诉讼法中都以列举的方式,对证据类型进行了明确的规定。但随着经济、科技的发展,许多证据以各种新的形式展现出来。特别是电子证据的出现,其独立的法律地位越来越受到大众的认同,但关于电子证据的认定以及其证明力的大小问题却始终困扰着司法审判实践。

In our Civil and Criminal Procedure Law,settings on types of evidence have been clearly defined by enumerating examples.With the development of economy,science and technology,many evidences appear with new types,especially electronic evidence.Although its independent legal status increasingly gets the public approval,the law recognition makes judicial judgment hard to practice all the time.
