宗教与法律在当代中国社会的良性互动研究

RESEARCH ON A VIRTUOUS INTERACTION BETWEEN RELIGION AND LAW IN CONTEMPORARY CHINA

分析了宗教与法律良性互动的必要性、条件和可能,提出了宗教与法律互动的模式和策略:坚持政教分离原则,保障宗教与法律的和谐共处。一方面要强化法律的社会控制功能,以法律确认、保护、引导宗教健康发展;另一方面要弘扬宗教的积极向善精神,以宗教陶冶、滋养、促进法律生长升华。

The paper analyzes the necessity, conditions and law and puts forward the mode and strategy of the and possibility of a virtuous interaction between religion virtuous interaction： adhere to the principle of separation of religion and politics and believe in protecting the harmony of religion and law. On the one hand, the social control function of the law should be strengthened to ensure the healthy development of religion and on the other hand the positive spirit of religion should be glorified to promote the growth of religion by nourishing and promoting the growth of law.
