Analysis of Administrative Punishment Cases in the Catering Sector of Wuhan in 2010

目的:分析2010年武汉市餐饮行政处罚案件,对存在的问题进行客观评价,为监督执法部门提供建议。方法:通过文献资料法、逻辑分析法对68件餐饮行政处罚案件进行案件违法主体、违法种类、涉案案值及案由等内容进行分析。结果:违法主体中餐饮单位居多;处罚种类以罚、没款和没收违法产品居多;案值多在2000元-5000元之间,案由主要集中在超范围经营和经营标签不符合规定的预包装食品。结论:加强对学校、企、事业单位食堂的监管、大力开展专项活动,加大处罚力度是餐饮服务监管工作的重要手段。

Objective：To analyze the administrative punishment cases in the catering sector of Wuhan city and to offer suggestions to the supervising and law enforcement department.Methods：Literature review and logic analysis were adopted,through which 67 administrative pun-ishment cases in the catering sector were analyzed and discussed in terms of the law violating subjects,categories,case value and causes.Result：Most legal subjects were restaurants,while few were canteens of enterprises or governmental institutions;the most common punishments include fine,confiscation of money or illegal products;case value is usually 2000 to 5000 RMB Yuan;the cause of case is mostly unauthorized business or selling prepackaged food without stipulated and formatted tags.Conclusion：Strengthen the supervision of the catering sector;efforts should be focused on the canteen in schools,enterprises or governmental institutions,the promotion of specialized activities and heavier penalties.
