民事诉讼中的公民代理问题研究

由于中国目前还不具备实行强制律师代理制度的条件,故公民代理制度在目前的司法条件下实有其存在之必要。为了更好地规范公民代理人,保障当事人的诉讼权利,维护司法秩序,可以采取措施缩小公民代理的市场,并将现有的公民代理人纳入法律规范的轨道。通过对公民代理制度的改进,可以使这一制度更好地发挥作用,并为诉讼代理制度向强制律师代理制度平稳过渡作准备。

Now it is necessary for procuration by the citizen to exist in China because procuration by the attorney is not forceful.To make the procuration by the citizen standard in a better way,to protect the litigation rights of parties,keep judicature in order,measures can be taken to narrow the sphere of the procuration by the citizen.And the procuration by the citizen can be into the law so that this system may be more effective,which will be a preparatory stage from the procuration by the attorney to the procuration by the citizen.
