对“老鼠仓”问题的几点浅思

近年来,由于基金黑幕、"硕鼠"落网等事件,众人将眼光重新聚焦于基金"老鼠仓"问题。事实上,"老鼠仓"现象并非基金所特有,而是证券市场发展到一定阶段的必然产物。"老鼠仓"的实质就是内幕交易,从目前世界各国的实践来看,"老鼠仓"顽症从未根治过。在证券市场,监管是永恒的主题。对于"老鼠仓"问题,不妨取消证券从业人员禁入令,变追堵为疏导,提高违法犯罪成本,启动民事究责机制,或许能取得不错的成效。

In recent years,due to the Fund Shady,＂big rat＂ arrested and so on,people re-focus on the ＂fund rat＂ problems.In fact,＂rat trading＂ is not a phenomenon unique to the fund,but an inevitable product when the stock market developed to a certain stage.Look at the practices over the world,＂rat trading＂ stubborn had never been cured.As to ＂fund rat＂ problem,cancel the off-limits to securities professionals,launch the civil responsibility mechanism,improve the criminal costs,start the civil responsibility mechanism,thus may receive good results.
