Research on the Game Playing and Legal Mechanisms of the Exploitation of the Groundwater Resources Protection of "Yellow River Delta"

"黄三角"开发上升为国家战略,这为"黄三角"发展带来良好机遇。但是"黄三角"生态脆弱,淡水资源相对贫乏,尤其是地下水资源因长期超量开采使用日趋枯竭,地下水位大范围下降、水质遭到污染,并引发地面沉降、咸水入侵等环境地质问题。严峻的现实决定"黄三角"开发必须重视地下水资源的保护,走发展高效生态经济之路。要在"黄三角"开发的大背景下维护地下水资源的可持续利用能力,必须完善法律机制,以形成制度保障。"黄三角"地区应应时所需,针对现行立法中地下水资源保护基本法缺乏、相关制度可操作性欠缺等不足,以可持续发展理念为导向,加快立法步伐、完善制度设计、加大惩处力度等,以使地下水资源得到切实有效的保障。

The 'Yellow River Delta' exploitation becomes a national strategy,which brings the 'Yellow River Delta' a good opportunity of development.However,the ecology of the 'Yellow River Delta' is fragile,freshwater resources are scarce,especially groundwater resources are depleting because of the long-term over-exploitation Many environment problems have arisen,such as,significant decline in groundwater level,contaminated water,and subsidence,salt water intrusion,etc.Because of severe reality,the 'Yellow River Delta' development must pay more attention to the protection of groundwater resources and takes the road of the development of efficient ecological economy.To maintain the sustainable use of groundwater resources in the background of large-scale development,the legal mechanisms should be improved for the protection.To resolve problems of existing legislation,such as,lack of basic laws about protection of groundwater resources,the lack of related systems operability,not enough penalties,etc,the 'Yellow River Delta' should accelerate the pace of legislation,improve the system design,increase the punishment under the guidance of sustainable development,so that groundwater resources can been better protected.
