在研究方法上,环境权的属性是一种理论假设,其构成了深入研究环境权体系的起点和基础,而现有的研究大多忽略了这一点。将环境权定位为一项基本人权是目前认可度最高、也最为合理的假设,但依照体系建构的要求,其还必须解决自身的普遍性和正当性问题。以习惯权利为基础区分环境权的应然和实然层面,可为环境权的基本人权属性提供更加充分的论证,也是进一步探究环境权体系的起点和基础。

In terms of researching method,the attribute of environmental right is a kind of theory assumption which constitutes the starting point and foundation for deeper study into environmental right,while this is the very aspect that the existing studies ignore.To define environmental right as a basic human right is by far the most rational assumption earning the highest recognition,but according to the demands of system construction,problems such as universality and legitimacy of itself must be tackled.The basis of customary right and division of environmental right from the aspects of ＂it ought to be＂ and ＂it is＂ provides further argument for environmental right being a basic human right,which is also the starting point and foundation for further research into environmental right system.
