论农村私有房屋权利瑕疵及解决——从登记和抵押制度上看 被引量:1

Analysis of the Defects in the Ownership of Country Private Buildings and Resolution to Them ——Based on the System of Registration and Mortgage

摘要 当前,涉及农村私有房屋的案件越来越多,其中,大多数涉及到农村私有房屋法律适用方面的问题———如何规范农村私有房屋买卖行为以及农村私有房屋的登记和设定抵押等。为保护农民对个人财产行使完整处分权,在维护当事人意思自治和缔约自由的前提下,法律必须保护合同的合法性和稳定性,建立农村私有房屋所有权登记制度和有条件抵押制度以保护各方利益。实际上,只要法律明确规定房屋购买人必须是自然人身份以及不得擅自改变宅基地用途,那么农村私有房屋就不会因为所有者的身份变化而轻易引发土地所有权性质的转变。 Recently, there are more and more cases that concern country private buildings. Most of them involve the issue of application of laws, for example, how to solve the problems about country private building's transaction, registration and mortgage etc with applicable laws. In order to protect the farmer's right of disposition of personal property, the law must protect the validity and stability of the contracts signed, establish the ownership's registration system and conditional mortgage to protect each party's benefit. In practice, if the law stipulates that the buyer's identity shall be natural person and the change of purpose of the land forbidden, the nature of ownership of land will not be affected by the change of identities of country private buildings' owners.
