摘要
2010年6月1日,旨在改革欧洲人权法院、提高法院效率的《欧洲人权公约第14议定书》生效。该议定书生效过程曲折,自2004年5月13日开放签署之后,早在2006年底即获欧洲理事会除俄罗斯以外的所有成员国的批准。因此,俄罗斯是欧洲人权法院这次改革得以实现的关键。笔者简要介绍该议定书的主要内容,并剖析该议定书成败之关键即俄罗斯的反应,在此基础上对改革后的欧洲人权法院及其对俄罗斯的影响加以评析。
On June 1,2010, Protocol no. 14 to the Convention for the Protection of Human Rights and Fundamental Freedoms entered into force. This protocol has been opened to signature since May 13, 2004, and all of the contracting countries to the Council of Europe except Russia have ratified it. Hence, Russia is the key point, which is critical to the realization of the reformation of the European Court of Human Rights. This article introduces the main content of the protocol and analyzes Russia's response to Protocol no. 14. Then, it analyzes the reformed European court of Human Rights and the influence on Russia.
