监狱作为监禁刑的主要执行机构，是刑法适用中刑罚执行环节的直接承担者。《刑法修正案（八）》（以下简称《刑八》）的颁布实施，对我国监狱工作的影响是巨大的，将直接触及现行监狱行刑制度的改良和监狱工作理念的根本性转变。因而，以监狱为本位，以贯彻社会主义法治理念为根据，领悟和分析《刑八》对监狱刑罚执行方面的立法本意，在此基础之上，树立中国特色的现代监狱行刑理念，实乃监狱法制的必由之路。
