摘要
《慈善促进法》正在加紧起草之中。在慈善组织取得主体资格条件、法律法规衔接问题、慈善信托等方面,借鉴国外慈善组织的法律建设和实践管理经验,提出相关的立法建议,以期为我国民间慈善组织有序健康发展提供良好的法制环境。
Nowadays the drafting work of Charities Promotion Law is under way.My paper,by taking into account such aspects as obtaining of the qualification of legal subject by charitable organizations,the cohesive issues of laws and regulations as well as the charitable trusts on the one hand,and by learning something from the experience of foreign organizations in constructing laws and managing enterprises on the other,put forward some law-making suggestions in the hope of creating a better,orderly and healthier environment for the development of China＇s charitable organizations.
