新农村建设中刑事法律援助的现状及对策

充分发挥刑事法律援助制度的刑事政策功能,对建设社会主义新农村、构建和谐社会具有重要的现实意义。但现实的情况是,由于现行立法的不足,农村经济发展的落后,农民法律意识淡漠,法律援助经费及人员得不到保障,致使现行的刑事法律援助制度在新农村建设中没有发挥其应有的作用。本文通过对我国刑事法律援助的现状分析,探讨如何在农村贯彻落实刑事法律援助制度,实现法律援助制度的刑事政策功能,以期有利于社会主义新农村建设及和谐社会的构建。

Bringing the criminal policy function of criminal legal aid system into full play will give an important realistic meaning to the construction of new socialism country and the formation of a harmonious society. But the reality is that the current criminal legal aid system has not given the rein to its due function because of the insufficient current legislation, undeveloped rural economy, indifferent peasant legal mentality and no guarantee for legal aid funds and staff. By analyzing the current situation of criminal legal aid in our country, the essay discusses how to carry out criminal legal aid system in rural area and achieve the criminal policy function of legal aid system to benefit the construction of new socialism country and the formation of a harmonious society.
