合作社制度的法律传统与未来理想研究——基于合作社价值的二元论视角

Study on the Legal Tradition and the Future Ideal of Cooperative System Based on the View of Dual Value about Cooperative

基于合作社经济性与伦理性的二元价值特征,对合作社制度的法律传统与未来理想进行了具体的阐述。研究结果表明,伦理价值是合作社生存的灵魂,经济价值是合作社发展的源泉,两者充满了现实主义与理想主义的矛盾,虽然合作社传统理论更多体现的是对伦理价值的坚守,但随着合作社经济价值的凸现,未来我国的合作社制度架构必然是侧重经济价值的追求,应在经济价值的实现中保持伦理价值。

Based on the dual value characteristics of economic and ethical of cooperation, the legal tradition and the future ideal of cooperative system were described specifically, between which, there were full of contradiction between realism and idealism. The resuhs indicated that al- though tradition theory of cooperation more reflected the holding of ethics value, along with the prominence of economic value of cooperation, the future structure of the cooperative system must be emphasis on the pursuit of economic value and keeps ethics value in the implementation of the economic value.
