摘要
受我国经济发展阶段及产业发展规律、政策效果的可识别性、政策功能的可替换性、法律约束强度、地方政府竞争等因素的影响,产业政策在地方层面被限缩为产业转移政策。在地方政府对资本展开争夺的过程中,劳动法的空间受到挤压,表现为降低劳动者保护标准、弱化制度实施、资本绑架体制、公权功能扭曲等。应当通过提高全日制用工比重、平衡地区之间的财政落差、实现最低限度的产业政策法律化、细化劳动政策考核指标等措施强化制度的可操作性,增强劳动法的制度竞争力,更好地保护劳动者权益。
Industry policies are narrowed by the local government.The factors include development stage of China's economy,industry development regularity,the identification of policies effects,the replaceability of policies functions,the intensity of legal restraint,the local government competition and so on.The space of labour law is squeezed in the process of local government fight over the capital.The following aspects can embody the consequence: to lower the performance standards of worker protections,to weaken of system enforcement,the capital kidnaps system,the function distortions of power.To strengthen the maneuverability of system by some measures,such as increasing the proportion of full-time employment,to balance the Financial gap between different regions,the legalization of industry policies,to detail the evaluation indicators of labour policy.Through these ways,to enhance the competitiveness of the labor law system and to protect workers' rights better.
