“两型社会”视阈下我国环境监管能力建设的制约因素及消解思路

Constraints and Digestion Ideas of the Environmental Supervision Capacity-building in the "resource-saving and environment-friendly society" in China

在"两型社会"视阈下创新科学合理的环境监管模式,既能提高环保监管效率,保证环境法律的有效实施,又能为"两型社会"建设提供有力支持,为完善我国环境法制奠定坚实的基础。目前我国的环境监管能力建设存在环境监管模式混乱、效率低下,民间环保NGO发挥不出应有功效的模式之痛;行政法、民法、刑法三大相关部门法不能很好地配合环境监管活动的开展;政府和民众的环境监管意识缺位等制约因素。而对症下药的消解良方即:厘清环境监管模式;完善相关法治;变革监管意识。

To innovate a scientific and rational environmental supervision model in the ＂ two types of society＂ can not only improve the efficiency of environmental monitoring to ensure the effective implementation of environmental laws,but also can give supporting for the ＂resource-saving and environment-friendly society＂ building,which is to lay the foundation for a solid improving environmental law basis.But,at present,China＇s environmental regulatory capacity-building mode exists confusion,inefficiency,and environmental NGO can not deliver excellent value.Administrative law,civil law,criminal law can not coordinated with the activities of environmental regulation very well.The government and the public don＇ t have enough awareness of the environmental regulatory and other constraints are not in place.The remedy is to clarify the mode of environmental supervision,improve the relevant rule of law;change regulatory awareness.
