摘要
任何一项制度在其运行过程都有得与失两个方面,秋审制度也是如此。秋审制度的得主要体现在使一些秋审冤案得到纠正,避免失误,同时它的有效运行,使社会成员得到一定的安全保护,从而稳定了当时的社会秩序,对当时政权运作起到了保护作用。秋审制度的失主要为,在运行过程中对案件改动过大;警戒功能的效果没有达到统治者的目的;秋审运行中体制的局限性也是十分明显的。
Like every other institution,Autumnal umpire is a double-edged sword.On one hand,it has its merits in that it could correct some misjudged cases,and its effective operation is helpful in maintaining social security,stabilizing social order and safeguarding the then political system;on the other hand,it has its demerits in over-changing some case judgments and failing to realizing the rulers＇ desire of warning function.Finally,its limitation is rather self-evident.
