关于征地补偿纠纷的调查报告——基于武汉市、鹤壁市的调查

A report on land acquisition and compensation disputes——Based on the investigation in the city of WuHan and Hebi

对武汉、鹤壁两市村庄进行调查,发现存在着大量的征地补偿纠纷,而现存的征地补偿纠纷解决机制却没有发挥应有的作用,这主要是由于制度层面的某些缺陷和失地农民深受传统意识的影响而存在认识上的偏差造成的。建议在澄清征地补偿过程中不同争议的性质的基础上,构建以行政程序、司法程序救济为主,多元化救济途径并存的体系,并积极促进失地农民传统意识的转变。

Based on the investigation of ten villages in Wuhan City and Hebi City,it is found that land compensation disputes have greatly affected the land expropriation,and the existing land expropriation dispute resolution mechanism doesn＇t play its role.The main reason is that the peasants,losing their farmland,were affected by the traditional sense deeply,resulting in the deviation on cognition.Besides that,there are a few system defects in the law and regulations.Therefore,clarifying the nature of the dispute in the process of the different land compensation,forming remedies of administrative procedure,judicial proceedings based,the coexistence of diverse ways of relief,promoting farmers changes in the traditional sense actively,only in this way can China improve the relief system of land requisition compensation and form the most effective relief to the landless peasants.
