和谐司法视野下民俗习惯在民事审判中的运用

On the Application of Folk Customs in Civil Trial in the Light of Harmony Judiciary

目前民俗习惯领域理论研究较多,而实证研究及技术程序研究则较为缺乏。民俗习惯在民事审判中的运用首先要确立民俗习惯的补充法源地位,明确民俗习惯司法运用的效力范围,对民俗习惯司法运用的启动、识别及确认设置相应的程序。在法官做出判决的过程中,进而对民俗习惯进行采纳适用,在判决理由中寻找合适的空间,将合乎情理的民俗习惯恰当地运用到民事审判的过程当中。

At present there is a lot of theoretical research on the folk customs field,while lack of the empirical research and technology program.In order to make an application of the folk customs in the civil trial,a status of the supplementary source of law for the folk custom should first be established,the scope of judicial validity of the folk customs should be made clear,and a procedure for how to start the use of folk customs,how to identify,and confirm folk customs is to be designed and discussed by this paper.In the process of judgments,a suitable space should be found for some reasonable folk customs to be used in a civil trial process.
