On Legal Recognition and Safeguard of Tourism Right

在现代社会,旅游权理应并正在逐步成为全社会公民均应享有的一项权利。旅游权作为一个法律概念的提出,其研究一直未得到理论界应有的重视。在我国旅游大发展的背景下,法律确认和保障旅游权显得尤为必要,它对保障宪法公民基本权利得以实现、公民自身得以发展、精神文化需求得以满足以及促进经济发展和就业都有重要作用。旅游权的内容主要包括旅游自由权、旅游平等权、旅游资源共享权、旅游保障权等,因此,法律应当从促进措施、旅游时间、旅游资源、具体旅游权利等方面加以确认和保障。

Tourism right,which shall be deemed to be enjoyed by the citizens,is gradually becoming an important human right in modern society.However,as a rising up legal concept,the research on tourism right has not yet attracted the theorists＇ enough attention.With the rapid development of China tourism industry,it is much more important to recognize and safeguard the tourism right.The recognition and safeguarding of the tourism right can greatly contribute to the realization of the constitutional rights and self-development of citizens,and promote economic development and employment.The tourism right will include the right to free travel,equal tourism rights,the right to share tourism resources,the right of tourism protection,etc.Therefore,the law should recognize and safeguard the tourism right,specifically to ensure the promotion measures,travel time,tourism resources,and some specific tourism rights.
