Analysis on the Damage of Trans-boundary Environmental Pollution

随着环境问题全球性,预防、治理环境污染已渐渐突破国家之界限,成为全世界共同关注的话题。跨境环境污染造成的损害日益威胁着全人类的生存和发展,保护全球环境"人人有责"。作为国际法最基本主体的国家在享有本国环境权利免受他国侵害的同时,承担着保证其本国管辖和控制内的各类活动不得给他国或国际社会造成损害之义务。反之,国家则需承担跨境污染所引起的法律后果,对本国给他国造成的损害负有国际赔偿责任。如果对各国跨境损害的行为不加以规制,可能导致行为国对其领土主权的滥用,不仅对受害国家而言有失公正,最终会损害人类的共同利益。因此,确定跨境污染损害的国家责任有其紧迫性与必要性。

With global environmental problems,preventing and fighting against environmental pollution has gradually breakthrough boundaries of a country and become the world common topic for concern.Trans-boundary Pollution does harm severely to surrounding nations and regions even to the environment of the world,which has big influence on human beings to survive and development.Each country enjoys the right to environment and protecting from pollution.At the same time,making environment pollution and injuring others,the country will undertake the compensation liability for the damage.International Compensation Responsibility has been one of the important systems for the International environment law.The focus of article is on how to resolve the problem of the trans-boundary pollution.
