Interest Protection and Guarantee of Pension Services

我国正在"未富先老"情势下"跑步进入"老龄社会,急至而来的老龄化、高龄化给世界上老年人口最多的中国社会带来了多重挑战。养老服务发展亟待法律上的维护,法制建设势在必行。但现阶段我国养老服务法制建构存在诸多问题,特别是其中内在关联的目标定位、平等权维护、行业准入、合同规范、救济制度、立法路径等基本问题,亟待认真审视并共事举措,力求因应改观,使养老服务得以可持续地规范化成长和运行。

China is running into the aging society in situations of old before getting rich, which has brought multiple social challenges. The development of pension services urgently needs the maintenance by law, so the construction of legal Sys- tem is imperative. However, there are many problems in the legal construction of pension services in China, in particular, such as the inter-related target orientation, equality, profession admittance, contract specifications, relief system and legislafive path, which is necessary to examine current situation earnestly, and then take appropriate measures to promote the development of pension services in a coherent and standardized manner.
