新闻自由与司法公正是民主与法治的基本要素,是民主国家追求的基本价值。其中,新闻自由是一项基本的宪法权利,推动着民主社会的良性运转;司法公正是构建社会主义法治的必备要素。但现实中传媒与司法之间的矛盾与冲突不断上演,如何平衡两者的关系成为亟须解决的时代课题。

Freedom of the press and the judicial justice are the basic elements of democracy and the rule of law, also are the basic value pursuits of democratic countries. Among them, the freedom of the press is a fundamental constitutional right, pushing democratic society＇s benign operation; Judicial justice is the required element of constructing the socialist rule of law. But in reality the contradiction and confilict between the media and judicature is staged continuously, how to balance the relationship between the two became the contemporary issues to be solved urgently.
