细读达马斯卡先生的《漂移的证据法》一书,从中收获良多。先生在比较法的视野下审视英美证据法的特征以及变迁,揭开了英美证据法独特而神秘的面纱,为我们完善证据立法、进行证据制度改革提供了兼具理论性和司法实践性的见解与经验。本文通过摘择精妙的论述语言,试图对其进行简要评析,并总结自己在阅读过程中的思考和心得体会。

After intensive reading of ＂Evidence Law Adrift＂ written by Mirjan R. Damaska, I＇ ve gained a lot. He gave an examination of the characteristics and changes of the Anglo-American law at an angle of comparative law, uncovering its unique and mysterious veil and providing theoretical and practical opinions for China＇ s evidence legislation and system reformation. In this article, the author will selectively extract his exquisite expression, make a simple comment on it, and summarize my capriccioso in the reading course.
