论《物权法》确立的物权变动新模式

《物权法》接受了区分原则也大量采用了公示对抗主义,这使得"物权意思+公示对抗"得以成为一种独立的物权变动立法模式。拆解物权变动立法要素可以明了:物权变动的主观要件是法典逻辑化、体系化的产物,客观要件是以什么样的立法技术反映"特定物"的结果。组合物权变动立法要素可以得出:物权意思的选项不仅满足了法典的体系唯美追求,而且也能实现法律所欲追求的目的;公示对抗的制度安排既可以澄清物权行为与物权公示的关系,也可以还物权公示法律机能之本来面目;实证研究表明:"物权意思+公示对抗"立法模式并非不曾有过,实为不曾发现过。我国民事立法宜将"物权意思+公示对抗"视为一种新的物权变动立法模式,并在此基础上纠正过去的一些错误认识。

The Chinese property law has accepted the division principle and adopted publicity confrontation ideology in quantity.This makes the real right meaning and the publicity confrontation to be one of independent legislation mode in real right transaction.Disassembling real right transaction constituents can help us to understand that the subjective requirement is the product of the logistic and systematic civil law code,the objective requirement is the result of how to using the legislation technology to response the specific good.Assembling the real right transaction constituents tell us that the choice of the real right can not only satisfy the aestheticism requirement about the civil law code,but also achieve the objective of the law.The institutional arrangement of the publicity confrontation clarify the relationship between the real right behavior and the real right publicity while show clearly the essence of the law function about the real right publicity.The empirical study show that we can determine that the real right meaning plus the publicity confrontation mode had not ever been accepted but never been discovered.Our civil legislation should treat the real right meaning plus the publicity confrontation as a new one and correct the wrong-doing before on the basic of it.
