构建西藏地方刑事被害人救助制度初探——以拉萨“3.14”事件为背景

Construction of the Local Victims Relief System in Tibet——On the Background of Lhasa "3.14" incident

从拉萨"3.14"事件看,构建刑事被害人救助制度是维护西藏和谐稳定的需要。目前,尽管建立全国性的刑事被害人救助制度的时机尚不成熟,但是,可从各地方试点做起,积极探索和积累刑事被害人政府救助的立法经验。西藏地方应当坚持从实际出发和量力而行原则,先实行政府救助,后推行政府补偿,并借鉴宁夏地方刑事被害人救助的做法,主要明确救助对象与范围、落实救助资金、严格救助审批程序。

From Lhasa ＂3.14＂ incident,Victim assistance system is constructed to maintain the need for harmony and stability in Tibet.At present,despite the immature of establishing a national victim assistance system,however,it can be started from the local pilot,and actively explored and accumulated bailout legislation victims experience.The Local government of Tibet should adhere to the principle of proceeding from reality and the affordable： first,the implementation of government assistance,then the implementation of government compensation.Learning from the practice of the local Victim Assistance in Ningxia,the main object and scope of assistance should be made clear,and the bailout funds and strict rescue procedures should be workable.
