现阶段管制刀具管理途径探析

Analysis of the Solutions to Managing Restrained Knives at Present

2002年国务院取消涉及管制刀具的四项行政审批项目后,管制刀具的管理进入盲区,治安管理处罚法实施以后,取消了对非法制贩管制刀具的处罚,弱化了对管制刀具违法行为的打击力度。尽管公安部要求对管制刀具要依据《对部分刀具进行管制的暂行规定》进行管理,但目前管制刀具的管理基本流于形式。有必要加强管制刀具管理的立法进度,加强对非法制贩管制刀具行为的管控措施,建立更科学的刀具管理体制。

In 2002,the State Council canceled the four administrative examination and approval items relating to restrained knives,the management of restrained knives is becoming blank.After the implementing of Law of the People＇s Republic of China on Penalties for Administration of Public Security,the punishment of illegally making and dealing restrained knives was canceled and the hitting power was weakened.The Ministry of Public Security of P.R.China requires managing restrained knives according to the Provisional Regulations of Controlling Partial Knives,but at present,the management of restrained knives is just formalistic.So the measures of struggling against restrained knives under the current legal conditions should be established and the management of restrained knives at present should be done well.
