浅析跨国制药巨头与国内制药企业之间的专利纠纷

Analysis of Patent Disputes between Multinational Pharmaceutical Magnate and Domestic Pharmaceutical Enterprises

目的:为国内制药企业应对或减少专利纠纷提供参考。方法:从跨国制药巨头与国内制药企业之间的专利纠纷案入手,深入分析案件背后的原因,进而提出对策。结果与结论:跨国制药巨头与国内制药企业之间存在专利纠纷的原因主要包括国内制药企业自身存在的不足、跨国制药巨头的专利战略日益升级以及专利本身的复杂性。国内制药企业应针对纠纷原因,从提高创新药物研发能力、增强专利意识以及主动利用专利本身的复杂性等方面入手,沉着应对与跨国制药巨头之间的专利纠纷,进而有效地回击跨国制药巨头发动的专利战。

OBJECTIVE： To provide reference for domestic pharmaceutical companies to counter or reduce patent disputes. METHODS： Starting from patent dispute cases between multinational pharmaceutical magnate and domestic pharmaceutical enter- prises, the reasons behind the cases were analyzed deeply to put forward countermeasures. RESULTS ＆ CONCLUSIONS： The rea- sons for patent disputes between multinational pharmaceutical magnate and domestic pharmaceutical enterprises mainly include the shortcomings of domestic pharmaceutical enterprises, multinational pharmaceutical magnate ambition to seize the domestic pharma- ceutical market, and the complexity of the patent itself. According to the above reasons, domestic pharmaceutical enterprises should increase research and development ability of innovative drug, enhance patent awareness, improve patent application level, utilize the complexity of the patent itself actively, and deal with patent disputes calmly, thereby fighting back patent wars waged by multi- national pharmaceutical magnate effectively.
