在市场经济背景下实现社会公共利益目标时,政府不能仅依靠行政管理手段,同时也需要考虑不同社会群体的利益平衡,通过各种奖励、协调、沟通等方式,促进城市发展中的社会和谐。本文试图结合上海城市规划管理中"文化遗产保护"这一利益矛盾较为突出的社会焦点,剖析城市管理实践中的困境与瓶颈,探讨有关建立上海历史文化遗产保护管理中发展权转移制度的可能性与相关问题。

To achieve public interest objectives in the background of the market economy,the government are required to change the way of management. Based on this point, it cannot simply rely on administrative means, but also need to consider how to balance the interests of different social groups through various incentives, coordination, and communication etc. This article attempts to analysis the problems in the heritage conservation administration and discusses the possible to introduce theTDR and related issues.
