摘要
铁路客运行业兼具营利性、公共性和高度垄断性的特征,这些特殊属性使得我们有必要对旅客这个群体倾注更多的关注。铁路客运行业存在迟延履行、对旅客人身财产损害等违约行为,这些违约行为的出现是由于一系列主客观原因所导致的。对旅客人身损害赔偿的15万元最高限额规定有失公平,与其他相关法律的规定也存在冲突。列车迟延到达所导致的赔偿范围问题仍需进一步界定,同时其违约责任的免责事由不应包括客观条件的局限性。
The passenger railway industry is a profit,public and monopolistic industry,these special characters make it necessary to put more attention to the passengers.There are some behaviors of breaking contract,for example delaying in performance and giving damage to the body and property of passengers,which is duo to a series of objective and subjective reasons.It is unfair that limiting a maximum of 15 million to compensate the passengers' body injury,and it exists conflict with the other relevant laws.The scope of compensation for delaying arrival needs further define.At the same time,the exemptions don't include the objective limitations.
