美国三权分立制度的审视有其特定的内涵、它是美国特定的政治、经济、历史、文化的产物,是资产阶级统治集团内部的民主政治。中国有自己独特的国情,因而绝不能照搬照抄其政治制度模式。但不照搬照抄不等于不借鉴其制度中折射的宪政思想,其宪法至上的原则、限权制衡的思想、人民主权与基本人权的原则无不体现着人类政治文明的成果。我们应结合中国的实际,以开放的心态共享人类政治文明的成果,不断完善社会主义法治建设。

By inspecting the connotation,cause and influence of American Power Separation System,we get to draw the conclusion that the power separation system is the typical American political,economical,historical and cultural production,and is the democratic politics governed by the capitalist class.China has the unique national conditions and thus can not copy the American political model blindly.However,we can still draw lessons from the constitutional thoughts reflected by the American system,which has embodied the political civilization fruit of human beings by the principle of constitutional supremacy,power restriction,popular sovereignty and basic human rights.Combined with the Chinese reality,we should keep an open mind to share the political civilization fruit of human beings and improve the socialist legal system.
