The Problem and Corresponding Measures in the Development Process of Our Country's Directors' and Officers' Liability Insurance Market

目前,在我国董事责任保险市场的发展过程中主要存在着三个方面的障碍:一是发展董事责任保险的现有法律依据不足;二是董事民事赔偿责任法律体系尚不健全,导致董事和高级职员对经营责任风险的重视程度远远不足;三是保险公司销售的董事责任保险合同在条款上存在诸多问题,因而难以适应我国的现实需要。因此,我国董事责任保险市场的进一步发展,有待于从根本上解决上述三方面问题。

Now there are three obstacles in the development process of our country＇ s directors＇ and officers liability insurance market： 1. The legal foundation for directors＇ and officers＇ liability insurance is not enough ; 2. The legal system of civil compensation liability of director is not perfect, which makes the director and officer despise the management hazard; 3. There are many problems in the clauses of directors＇ and officers＇ liability insurance contract, which makes it very difficult to meet the need of our country. So, to pro- mote the development of our country＇ s directors＇ and officers＇ liability insurance market, we should settle the above three problems radically.
