网络环境下图书馆著作权合理使用的制度性思考

Institutional Considerations about Library's Fair Use of Copyright under Network Environment

著作权合理使用制度作为平衡著作权人与著作权使用人利益的制度,在许多国家都有相关规定。然而在网络环境下,随着技术的发展,著作权人的权利得到了不断扩张,合理使用的范围却越来越小,有人甚至认为,合理使用制度将从著作权法中消失。从著作权合理使用的制度价值及图书馆的制度价值入手,分析了在网络环境下著作权合理使用制度存在的合理性,探讨了适合图书馆的著作权合理使用制度。

Being as a system for balancing the interests of the copyright owners and the copyright users,the fair use system has relevant regulations in many countries.However,under the network environment,the copyright owners＇rights have got expanding along with the development of technology,the scope of fair use is getting smaller and smaller,some people even think that fair use system will disappear from copyright law.From the system value of the fair use and the system value of library,this paper analyzes the rationality of the existence of copyright＇s fair use system under network environment,and probes into the copyright＇s fair use system suitable for the library.
