摘要
当前,中国劳动争议处理机制的完善问题面临着两方面的挑战:全球"强资本、弱劳工"的整体性劳资格局,加剧了中国劳动者的弱势地位;以跨国公司为代表的强资本消解了主权国家对资本的中立性及国家对资本的有效约束能力,构成了对国家的主体性侵害。由此决定了我国原有的劳动争议处理机制的立法初衷无法实现。《劳动争议调解仲裁法》的出台,标志着国家为应对全球化挑战而在劳动争议领域实现了调整策略的的自我转变———由国家主导劳动争议解决的"统治型"(government)向引导多元社会力量共同参与的"治理型"(governance)转变。
To consummate the handling mechanism in individual labor disputes there are two challenges that globalization brings along. The first challenge is that the totalistic pattern of "strong capital, weak labor" aggravates the weak situation of Chinese workers. The second one is that the strong capital emboding with multinational corporations prejudices the state's autonomy by counteracting the capital. neutrality The legislati government beyond the capital and on desire of the handling mechanism the capacity of government to restrict the in individual labor disputes can not be realized due to the two challenges. Hence these decide the legislative motion can not be achieved. Law of the People's Republic of China on Mediation and Arbitration of Labour Disputes implies a self-transformation that is from government by which state dominates the solve of labour disputes to governance by which state leads pluralistic social faceors to solve labour disputes.
