完善农村土地承包经营权流转制度的法律思考

Legal thinking of perfecting countryside land contracted management right circulation

农村土地承包经营权的规范有序流转不但事关广大农民的切身利益,而且关乎农业生产的持续发展和农村改革、发展、稳定的大局。针对我国现行农村土地承包经营权流转法律制度存在的诸多不足,应从强化土地承包经营权的物权属性,赋予农民完整的土地产权,完善土地流转登记制度,健全土地流转的市场化运作制度三方面加以完善。

The legal and orderly assignment of contractual right of the rural land is related not only to the vital interests of the vast majority of peasants,but also to the continuous development of the agricultural industry and the general situation of countryside reform,development and stabilization.In view of the defects in the legal system of the assignment of contractual right of the rural land,this thesis argues that the legal system shall be perfected through three aspects：consolidating the real right attribute of contractual right of the rural land and bestowing complete land title on the peasants,improving the registration system of the rural land assignment,and establishing the sound market system for the rural land assignment.
