境外土地征用赔偿制度演变阶段特征分析

Analysis on the Evolution of the Domestic and Overseas Land Requisition Compensation System

随着经济的快速发展,国家城市化和工业化进程的不断加快,由土地征用而带来的社会矛盾冲突也不断增多。目前世界各国均认为其实施的土地征用标准是建立在合理补偿基础之上的,然而什么是合理补偿,合理补偿的标准是什么,一直是理论界和政府土地管理部门关注的研究热点。文章结合世界上主要国家的土地征用补偿演进的历史背景、从经济发展、土地利用率、人口密度等几个指标对征地补偿标准演化的阶段进行了划分,结合我国土地征用补偿的实际情况,探索我国现阶段所处的土地征用补偿阶段。分析其他国家不同阶段的制度背景,以期对我国的征地补偿问题及发展趋势有一个比较清晰的认识,以完善我国土地征用补偿制度。

With the rapid development of China’s economy,urbanization and industrialization,the social contradictions and conflicts are increasing unceasingly.At the moment,each country declares that their implementation of the reform of land Requisition compensation is reasonable,but the problems of what is reasonable compensation and what is the criteria for compensation have been the hot spots of the research of the theory field and the world land management department.In this paper,the author combines the historical background of the evolution of the land requisition compensation in the major countries all over the world,and divides the evolution of the land requisition compensation standards into several stages from the angle of the stage of economic development and the land utilization indicators,combines the actual situation in China,aiming to explore the stage of the compensation for land expropriation.Learning the advanced system from other countries to establish the development direction of compensation for land acquisition,in order to have a more clear understanding of China’s land requisition compensation and the developing trend and improve the land requisition compensation system in our country.
