通过案例引出大规模侵权面临的相关现实问题,从诉讼困难使受害人的权益难以获得保障、单一的赔偿方式导致企业破产、受害人无法获得真正的救济等方面分析了大规模侵权损害赔偿存在的各种问题,建议通过责任保险制度和企业专项赔付基金相结合的方式来解决这些问题。

The relevant problems about the damages of mass torts are introduced from some cases. The problems existing in the damages of mass torts are analyzed from the following aspects ： the difficulty of litigation that makes the right of victims hard to be ensured, the single compensation way that results in the bankruptcy of enterprises, and the difficulty to get real relieves for victims. Finally, it is suggested to solve these problems by combining the liability insurance system with the enterprise special compensation fund.
