“宽严相济”语境下对未成年犯监禁矫正现状的思考

On "Leniency" Imprisonment for Juvenile Offenders in the Context of the Present Situation of Correction

未成年人犯罪,应当受到刑罚处罚,但处罚适当与否,矫正的效果如何,不仅关系到未成年犯今后的前途,还会产生长远的社会影响,其意义远超出处罚本身。目前,未成年犯监禁刑罚已显现出明显的弊端,笔者从未成年犯监禁矫正现状入手,从贯彻"宽严相济"刑事政策利于教育和保护未成年人的角度出发,探讨对未成年犯罪刑罚适用及矫正中的相关问题。

Juvenile delinquency should be subject to criminal punishment,but whether such a punishment is appropriate or not,and what effect the correction may produce,will not only decide the future of juvenile offenders,but also have a long-term social impact,and its significance is far beyond the punishment itself.As the current sentence of juvenile offenders has shown some obvious disadvantages,and from the angle of implementation of ＂combining punishment with leniency＂ criminal policy so as to educate and protect juvenile,the author probe into the relevant issues in the correction of juvenile offenders by analyzing the status quo of correction from imprisonment for juvenile offenders.
