摘要
《鹿特丹规则》是国际海上货物运输合同统一法的本位回归。《鹿特丹规则》的背离规定是国际海上货物运输合同自由的最直接体现和合同自由空前扩大的标志。在国际贸易实务中,当事人应对任何与背离有关的事项进行成本和利益的权衡分析。在《鹿特丹规则》背景下的批量合同和保险场合下对Incoterms 2000的贸易术语的选择显得更加重要。
The Rotterdam Rules are the natural and ultimate return of the uniform law of contracts for the international carriage of goods by sea. The stipulations concerning derogation in The Rotterdam Rules are the most direct reflection of and the very symbol of unprecedented expansion of contractual freedom of international carriage of goods by sea. In international trade practices, the parties involved should undertake a cost versus benefit analysis of all the issues related to any contemplated derogation. The increasing importance of the choice of trade terms of Incoterms 2000 should be highlighted in the context of volume contracts and insurance under The Rotterdam Rules.
