Legal nature of"car-sharing"and legal relationships among subjects concerned

"拼车"是一种新兴的出行方式,目前并无专门立法针对其予以规范。因此明确"拼车"行为的法律性质及其所涉及主体间的法律关系就十分有必要。文章通过对拼车类型的列举、拼车行为性质以及相关主体间法律关系的分析,明确了"拼车"行为的基本概念及基本法律关系。拼车行为分为无偿和有偿两种,相关主体之间的法律关系也在此基础上有具体的区别,例如好意同乘、合同关系和合伙关系等等。

＂Car-sharing＂ is a new way of travelling for which there is no specific legislation till now.It is necessary to make clear the basic nature of ＂car-sharing＂ and the legal relationships among the main subjects.Based on the types,the nature of ＂car-sharing＂ and the legal relationships among its subjects,clear elaboration was made on its basic ideas and legal relationships.＂Car-sharing＂ is divided into two types：paid and free,according to which the legal relationships among the main subjects are classified,too,such as good will pick-up,contract relationship and partnership.
