文章从一起出售非法取得网络游戏玩家数据库资料的案件入手,阐述了对该案件犯罪行为认定的分歧观点及其理由,再从法理的角度详细分析了网络虚拟财产的性质认定及刑法保护的合理限度,以及对网络犯罪的共犯的认定。
This article was proceeded with a case about sale of computer game data and information which was illegal obtained, explained the differences and relevant reasons about criminal action cognizance, then amply analyzed the nature of network property, the reasonable bound of criminal law protection and the cognizance of cyber-crime complicity.
