对于残骸强制打捞清除,我国一直没有一部完善的法律对其进行调整。《残骸清除公约》的通过,代表了国际上残骸清除的发展趋势,分析我国现有立法的缺陷,顺应国际趋势完善我国相关立法,理智探讨是否应当加入该公约已成为我国法律界急需解决的问题。

The legislation on wreck removal is vacant in our country as yet.However,the adoption of The Nairobi International Convention on the Removal of Wrecks shows the development tendency on wreck removal in the international society.The urgent issues are to analyze defects of current legislation in order to improve relevant legal system as well as to discuss reasonably on whether to join in the convention or not.
