摘要
随着互联网运用的不断普及,"人肉搜索"对大多数人来说已不再陌生。在对违反道德的行为起到一定震慑作用的同时,"人肉搜索"也经常对公民的隐私权构成侵犯,在法律上面临否定性评价。不断出现的"人肉搜索"案例凸显出我国现行法律对隐私权保护的不足。本文主要从完善立法、对网络运营商、网上发帖人的管理等方面对我国"人肉搜索"中隐私权法律保护制度的保护提出建议。
With the increasing popularity of Internet application,＂human flesh search＂ is common to the public,it awe to the immoral behaviours and meanwhile it violated civilian＇s privacy right,and facing a positive assess in legal.Increasing ＂human fresh search＂ cases show that shortage of the protection of our law to the privacy rights.This paper mainly from improve the management of legislation,network operators,post online to control legal privacy protection in our online ＂human fresh search＂.
