海域多层次利用中使用权分层确权初探

在现代科学技术的推动下,人们已经开始对不同深度、不同层次的海域空间进行有效利用,而海域多层次利用中的使用权分层确权问题也已成为海域进一步有效利用的限制条件。论文从所有权、物权理论以及海域的立体应用三个方面分析了海域在多层次利用中分层确权的可行性,并对分层确权过程中的原则、如何分层、应该注意的问题进行了研究,得出海域在多层次利用中应该分为水面使用权、水体使用权、海床使用权、底土使用权以及综合使用权五个层次。

With the impulse of the modem science and technology, people are beginning to utilize the different depth and levels sea areas, the problem of separating usufruct into layers in sea areas of multilayered use has become the restricted conditions for more effective use of the sea areas. The paper analyses the feasibility of the separate usufruct into layers in sea areas from the ownership, how to separate usufruct into layers, and the problem that should be paid attention to. The sea areas should be separated usufruct into five layers, such as the right to use of surface, the right to use of water, the right to use of subsoil, the right to use of seabed, the right to use of synthesizes.
