摘要
文章针对我国现行仲裁制度在纠错机制和仲裁员聘任方面存在的问题,提出了设置仲裁自我纠错机制、终局纠错机制的新主张和案外人执行异议制度与仲裁制度衔接的具体办法,分析了公务员兼任仲裁员的违法性和内部仲裁员的危害,提出合理配置各种专业仲裁员的建议。
The article reviews the existing arbitration system and points out the problems in error-correcting mechanism and the employment of arbitrators, and proposes setting up self-correction mechanism, the final-correction mechanism and some measures for combining demurral system of the third party execution with the arbitration system. The article analyzes the detriment of civil servants and internal clerks serving as arbitrators and puts forward the rational placement of various professional arbitrators.
