动产与不动产的区分作为民法上对物的基本分类,具有表现动产与不动产的价值差异、构架物权法体系的基础、广泛的国际认同度等意义。关于动产与不动产的划分,学界有不同的观点,实际上主要是物理标准与登记标准的分歧。我国未来立法仍应当坚持物理标准。

The division between chattel and realty is the foremost classification of property in civil law.This kind of division has the function of revealing the value variance between chattel and realty﹑constructing the foundation of real law system,and won widespread international consent.Different scholar adopts different criterion to divide them,in fact the difference is between registration criterion and physical state criterion.The future law of our country should insist the criterion of physical state.
