Research of the Perpetrating Act of Bribery Crime of Influence

利用影响力受贿罪的实行行为包括两个部分:一是利用影响力,二是索取或收受财物。"为他人谋取不正当利益"虽然是犯罪成立必备的条件,但不是实行行为的组成部分。在利用影响力与索取或收受财物的行为跨越了刑法修正案(七)的情况下,也应当适用刑法修正案(七)修正之后的刑法。

The perpetrating act of bribery crime of influence consists of two parts： the use of influence,and soliciting or accepting trustees of the property.Although ＂seeking illegitimate interests for others＂ is requisite to constitute the crime,it is not part of the implementation of perpetrating act of bribery crime of influence.If the act of the use of influence and the act of soliciting or accepting trustees of the property across the Amendment VII to the Criminal Law,the Amendment VII to the Criminal Law shall also be applied.
