摘要
文章从标准与专利技术在内容上的共性和差异、标准与专利权在性质和法律特征上的区别、标准化制度与专利制度最终目的的趋同性等几个方面,详细论述了标准与专利的关系,为解释标准与专利结合的正当性及正确处理标准实施和专利权的冲突提供参考。
In this paper,the relationship between standards and patents has been elaborated from several perspectives, including the commonalities and differences between standard and patent technology in terms of contents, the differences between standard and patent right in nature and legal characteristics, and the ho- moplasy in ultimate goals of standardization system and patent system, which provide the references for ex- plaining the validity of combination of standard and patent and the conflict between standard implementation and patent right.
